These Terms & Conditions (“Agreement”) apply to the services provided by ASW Maintenance Group. By accessing or using our services, you agree to be bound by these Terms & Conditions outlined herein and any further agreements made between you and our team at ASW Maintenance Group.
Services
ASW Maintenance Group facilitates a variety of maintenance solutions to our customers in commercial and industrial sites across Sydney.
Our services may include, but are generally not limited to:
facility maintenance;
logistics support;
emergency repairs;
car park and external works;
electrical and plumbing; and
interior design.
Service Agreements
Service agreements will further outline the details of the services, pricing, timelines and scope of services subject to your circumstances.
These agreements will be executed by both parties (You and ASW Maintenance Group) prior to the commencement of any services. You are responsible for providing accurate, complete, and timely information regarding the project to enable ASW Maintenance Group to deliver the services in accordance with the agreed specifications and to ensure client satisfaction.
Pricing & Payment
The specific terms of payment shall be outlined in the service agreement. This may include deposit requirements, pricing, due dates and payment terms.
Please note that:
ASW Maintenance Group reserves the right to impose additional fees for any requests or services that fall outside the scope of work initially agreed upon.
Unless otherwise expressly provided in writing within the service agreement, all payments shall be made in full prior to the provision of any services.
Failure to comply with the agreed payment terms may result in delays, suspension, or cancellation of the services.
Your Responsibilities
You must ensure the project location is accessible and safe for our team to attend and provide the services. Any required permits must be discussed prior to the agreed date and obtained by you in advance.
Cancellations & Refunds
You must provide written notice if you wish to cancel or reschedule the service.
Specific refund terms may be outlined in the service agreement.
Cancellations made within the specified time frame may qualify for a refund subject to the terms of the service agreement.
Limitation of Liability
To the extent permitted by law, ASW Maintenance Group disclaims all representations, warranties and conditions, express or implied. ASW Maintenance Group is not liable for any indirect, incidental, or consequential damages, including loss of business, revenue, or reputation. As a result of accessing our services, you assume full responsibility for any actions or decisions that you may make, including any third-party relations.
ASW Maintenance Group is not responsible for any damages caused by you or other third-parties or for any damage caused due to pre-existing conditions at the project site.
Further, ASW Maintenance Group shall not be held liable for any failure to fulfill obligations due to circumstances beyond our control, including but not limited to natural disasters, strikes, or government restrictions.
Indemnification
You agree to indemnify and hold ASW Maintenance Group harmless against any claims, damages, or losses arising from their negligence or failure to comply with the terms.
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of New South Wales, and any disputes will be resolved in the appropriate courts within that jurisdiction.
Changes to Terms
ASW Maintenance Group reserves the right to modify these Terms & Conditions at any time without prior notice. Any changes will be effective immediately upon publication on the website. You will be notified of any significant changes.
